Rights & Usage

At Ideare Agency, we believe original creative ideas carry real commercial value. When you purchase one of our design services, you are not simply receiving a visual concept, you are receiving the agreed commercial rights to take the final approved design forward into development, manufacturing, marketing and sale.

Unless otherwise agreed in writing, By Ideare retains ownership of the applicable underlying intellectual property connected to the concepts and designs created during the project. This means that the standard project fee gives you the right to commercially use the final approved design, but it does not automatically transfer full legal ownership of the design itself.

To protect the integrity of your project, By Ideare will not knowingly resell, reproduce or license your exact final commissioned design to another fashion brand.

Only the final approved concept is included within the standard commercial rights unless otherwise agreed. Unused concepts, rejected directions, exploratory ideas and unselected variations remain with By Ideare and are not automatically included for commercial use.

If your brand requires broader exclusivity, rights over additional variations, or full ownership of the design and its applicable intellectual property, this can be discussed separately and agreed through a separate written licence or IP assignment. Please contact us for further information.

Our aim is to give every client the commercial freedom they need to confidently bring their design to market, while protecting the value of the original creative work behind it.

Frequently asked questions

Do I own the design after purchasing a service?

Not automatically. When you purchase a By Ideare service, you receive the agreed commercial rights to use the final approved design for your brand, including the ability to move it into development, manufacturing, marketing and sale.

By Ideare retains ownership of the applicable underlying intellectual property unless full ownership is separately agreed in writing.

Your standard project fee is therefore for the creative service and the commercial licence to use the approved design — not an automatic transfer of full IP ownership.

Can I purchase broader exclusivity?

Yes. Broader exclusivity can be discussed separately where required.

Our standard terms are designed to allow you to commercially use your final approved design, and By Ideare will not knowingly resell or license that exact final commissioned design to another fashion brand.

However, some clients may require wider exclusivity around related variations, a particular design family, product category, territory or period of time. Where this is required, the scope of exclusivity will be agreed separately and quoted according to the level of protection requested.

What is the difference between commercial rights, exclusivity and full IP ownership?

Commercial rights give you permission to use the final approved design commercially — for example, to develop, manufacture, market and sell products based on it — while the applicable underlying intellectual property remains owned by By Ideare.

Broader exclusivity gives your brand additional protection beyond the standard commercial licence. Depending on the agreement, this may restrict By Ideare Agency from licensing or developing closely related versions of the concept within a defined product category, territory, timeframe or other agreed scope.

Full IP ownership is different again. This involves the transfer of the applicable intellectual property rights themselves, meaning ownership moves from By Ideare to the client. Full IP acquisition is not included within our standard service fees and, where available, is negotiated separately on a case-by-case basis.
